Welcome to King Auto Group. These Terms of Service ("Terms") govern your use of our vehicle servicing and repair services. By booking an appointment or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website at kingates.com, booking an appointment, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Service Description

King Auto Group provides professional vehicle maintenance, repair, and servicing solutions including but not limited to:

  • Routine maintenance and inspections
  • Engine diagnostics and repairs
  • Brake system services
  • Transmission services
  • Electrical system repairs
  • Body work and paint services
  • Parts replacement and installation
  • Emergency roadside assistance (where available)

3. Booking and Appointments

3.1 Appointment Scheduling

Appointments can be scheduled through our online booking system, by phone, or in person. We will confirm your appointment via email or SMS. Appointment times are estimates and may be subject to change based on operational requirements.

3.2 Cancellation Policy

Customers may cancel or reschedule appointments at least 24 hours in advance without penalty. Cancellations made less than 24 hours before the scheduled appointment may be subject to a cancellation fee of up to $50.

3.3 No-Show Policy

Failure to appear for a scheduled appointment without prior notice may result in a no-show fee and may affect your ability to book future appointments.

4. Service Estimates and Pricing

4.1 Estimates

All service estimates are provided in good faith based on initial inspection and diagnosis. Final costs may vary if additional work is required or unforeseen issues are discovered during service.

4.2 Authorization

We will contact you for authorization before performing any work that exceeds the original estimate by more than 10% or $100, whichever is greater.

4.3 Payment Terms

Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, credit cards, debit cards, and approved financing options. A deposit may be required for extensive repairs or special order parts.

5. Vehicle Custody and Liability

5.1 Care of Vehicle

While your vehicle is in our custody, we will exercise reasonable care to protect it from damage. However, we are not responsible for:

  • Loss or damage to personal property left in the vehicle
  • Pre-existing damage or conditions not related to our services
  • Damage resulting from hidden defects or conditions that could not be discovered through reasonable inspection
  • Normal wear and tear

5.2 Vehicle Storage

Vehicles left on our premises for more than 30 days after service completion may be subject to daily storage fees. We reserve the right to place a mechanic's lien on vehicles for unpaid services or storage fees.

5.3 Pickup Service

If you opt for our vehicle pickup and delivery service, you authorize us to operate your vehicle for the purpose of transportation to and from our facility. You are responsible for ensuring your vehicle is legally operable and properly insured.

6. Parts and Materials

6.1 Parts Quality

Unless otherwise specified, we use quality aftermarket or OEM (Original Equipment Manufacturer) parts. You may request specific parts brands, which may affect pricing and availability.

6.2 Parts Warranty

Parts are covered by the manufacturer's warranty. We will assist in warranty claims but are not responsible for manufacturer defects or warranty limitations.

6.3 Customer-Supplied Parts

If you choose to supply your own parts, we cannot guarantee their quality, compatibility, or performance. Our warranty will not cover failures related to customer-supplied parts.

7. Warranties and Guarantees

7.1 Workmanship Warranty

We warrant our workmanship for a period of 90 days or 3,000 miles (whichever comes first) from the date of service. This warranty covers defects in our work but does not cover:

  • Normal wear and tear
  • Damage from accidents or misuse
  • Failure of parts not installed by us
  • Consequential damages

7.2 Warranty Claims

To make a warranty claim, you must return the vehicle to our facility for inspection. We reserve the right to determine the appropriate remedy, which may include repair, replacement, or refund.

7.3 Limitation of Liability

Our total liability for any claim related to our services shall not exceed the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

8. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate information about your vehicle and its condition
  • Disclose any known issues or previous repairs
  • Remove all personal and valuable items from your vehicle
  • Maintain valid insurance coverage on your vehicle
  • Pay for services in accordance with our payment terms
  • Pick up your vehicle within a reasonable time after service completion

9. Diagnostic Services

Diagnostic fees are charged to identify vehicle issues and are separate from repair costs. If you authorize the recommended repairs, diagnostic fees may be applied toward the total repair cost. Diagnostic fees are non-refundable if you decline the recommended repairs.

10. Safety and Compliance

We reserve the right to refuse service or return of a vehicle that we determine to be unsafe for operation. We may be required by law to report certain vehicle conditions to appropriate authorities.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of King Auto Group and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your information as described in our Privacy Policy.

13. Dispute Resolution

13.1 Informal Resolution

If you have a complaint or dispute, please contact us first at contact@kingates.com. We will make every effort to resolve the issue informally.

13.2 Arbitration

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in our local jurisdiction.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KING AUTO GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use our services
  • Any unauthorized access to or alteration of your vehicle or data
  • Any interruption or cessation of services
  • Any bugs, viruses, or other harmful code
  • Any errors or omissions in content or services

15. Indemnification

You agree to indemnify, defend, and hold harmless King Auto Group, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your use of our services.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

19. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific terms, constitute the entire agreement between you and King Auto Group regarding our services and supersede all prior agreements and understandings.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our principal place of business is located, without regard to its conflict of law provisions.
